Understanding the Party Wall Act of 1996

It was a private members bill drafted by the late John Anstey; an authority on the process developed during its years of application in London. In 1996 the Act was spread across the rest of England and Wales.

If you are looking for advice on whether you should serve notice under the Act, and if so who you should appoint, then please take note of the following:

  • You need to use a competent person to act for you
  • Ideally they should be members of a professional body such as the RICS, and belong to an association such as the Pyramus & Thisbe Club which sets standards and requires competency for membership
  • They should be experienced in the type of project you are contemplating. A domestic extension is vastly different to a tower block in a city centre

We cover all sizes of scheme and are both willing and competent to deal with any project from a domestic extension to a multi-million pound city centre development. Be wary of using a low cost service which purports to issue notices at unrealistic rates.

If the initial notice procedure is not comprehensive, and covers all possible eventualities, then it can and often does lead to a costly restart with attendant delays as the notice can be invalid. Never forget that once you have appointed your party wall surveyor you cannot get rid of them. They are protected by the Act to preserve their impartiality so read the small print with any appointments.
